Company fined for not identifying a waterbody prior to construction
Rocky Mountain House... The Provincial Court of Alberta has penalized Devon Canada Corporation $85,000 under Alberta’s Water Act for failing to identify a waterbody crossing prior to construction of a pipeline.
As part of creative sentencing, $60,000 of the total penalty will be used to establish a bursary for residents of Clearwater County who are accepted into a diploma program in Land and Water Resources at the School of Environment at Olds College. The remaining $25,000 will be paid as a fine.
In 2008, Devon Canada, a natural gas and oil production company, began exploring possible routes for a proposed pipeline to deliver natural gas from a new well to their existing pipeline west of Rocky Mountain House. In September 2009, the company submitted a notification to Alberta Sustainable Resource Development that failed to identify a waterbody crossing, commonly known as Baker Road Creek. This omission violated requirements under the Water Act that stipulate a company must identify waterbody crossings and provide details about how impacts will be mitigated.
